Welcome to Chair Masters. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

1. Service Description

Chair Masters provides office chair repair, reupholstery, and maintenance services for businesses and individuals in Canada. Our services include but are not limited to:

  • Upholstery replacement
  • Mechanism repair
  • Express servicing
  • Custom modifications
  • Commercial services

The specific details, pricing, and turnaround times for each service will be provided upon request and may vary based on the scope of work required.

2. Service Agreements

When you engage our services, we will provide you with a detailed quote outlining the scope of work, pricing, and estimated timeline. By accepting our quote and proceeding with the services, you agree to the terms specified in the quote, in addition to these Terms of Service.

3. Website Use

3.1 Permitted Use

You may use our website for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the website in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to any portion of the website
  • Use the website to transmit malicious code or interfere with its functionality
  • Collect or harvest any information from the website without authorization
  • Impersonate or attempt to impersonate Chair Masters or any of its employees

3.2 Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Chair Masters or its content suppliers and is protected by Canadian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content from our website without our express written permission.

4. Payment Terms

4.1 Pricing

All prices displayed on our website or provided in quotes are in Canadian Dollars (CAD) and are subject to change without notice. We reserve the right to modify our pricing at any time. Price changes will not affect orders for which we have already issued a confirmation.

4.2 Payment Process

For repair and reupholstery services, we typically require:

  • A 50% deposit to begin work
  • The remaining balance upon completion of the work, prior to delivery or pickup

For commercial clients with established relationships, we may offer different payment terms, which will be specified in your service agreement.

4.3 Payment Methods

We accept the following payment methods:

  • Credit cards (Visa, MasterCard, American Express)
  • Debit cards
  • Electronic funds transfer (EFT)
  • Checks (for commercial clients only)

5. Service Warranties

We stand behind the quality of our work and offer the following warranties:

  • A 2-year warranty on all repair work covering defects in workmanship
  • A 1-year warranty on upholstery covering defects in materials and workmanship

These warranties do not cover damage resulting from misuse, accidents, or normal wear and tear. Specific warranty terms may vary for different services and will be detailed in your service agreement.

6. Cancellation and Refund Policy

6.1 Cancellations

If you need to cancel a scheduled service:

  • Cancellations made more than 48 hours before the scheduled service: Full refund of any deposit
  • Cancellations made less than 48 hours before the scheduled service: 50% of the deposit may be retained as a cancellation fee
  • Cancellations after work has begun: Deposit is non-refundable, and additional charges may apply based on the work completed

6.2 Refunds

If you are not satisfied with our services, please contact us within 7 days of service completion. We will work with you to address your concerns and, if necessary, repair or redo the work at no additional cost. If we cannot resolve the issue to your satisfaction, we may offer a partial or full refund at our discretion.

7. Liability Limitations

To the maximum extent permitted by law, Chair Masters shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use our services
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from our website
  • Any bugs, viruses, or the like that may be transmitted to or through our website

Our liability is limited to the amount you paid for the specific service that is the subject of the claim.

8. Dispute Resolution

If a dispute arises between you and Chair Masters regarding our services or these Terms, we agree to the following dispute resolution process:

  1. Informal negotiation: We will attempt to resolve the dispute through good-faith negotiation.
  2. Mediation: If negotiation is unsuccessful, either party may initiate mediation by a neutral third party.
  3. Arbitration: If mediation is unsuccessful, the dispute will be resolved through binding arbitration in Toronto, Ontario, in accordance with the rules of the ADR Institute of Canada.

This dispute resolution provision does not prevent either party from seeking injunctive or other equitable relief from a court for a breach or threatened breach of these Terms.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our website or services after any changes to these Terms constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any principles of conflicts of law.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
